Overview 

This website is operated by Sulm8 Shoes. The terms “we”, “us”, and “our” refer to SULM8. SULM8 offers this website, including all information, tools, and services to you, the user, conditioned upon your acceptance of all terms, conditions, and policies stated here. Sulm8 Shoes is powered by Shopify, which enables us to provide the Services to you.

SECTION 1 - Access and Accounts

By agreeing to these Terms, you represent that you are at least the age of majority in your province of residence. You are solely responsible for maintaining the security of your account credentials and for all activity occurring under your account. You represent that all information provided is correct, current, and complete.

SECTION 2 - Prohibited Uses

In addition to other prohibitions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to infringe upon or violate our intellectual property rights or the rights of others; (d) to upload or transmit viruses or any other type of malicious code; (e) to collect or track the personal information of others; or (f) to interfere with or circumvent the security features of the Service. We reserve the right to terminate your use for violating any prohibited uses.

SECTION 3 - Products and Custom Orders

  • Product Information: We strive for accuracy, but colors or product appearance may differ based on your device settings. Descriptions are subject to change without notice.

  • Custom Orders: These are made-to-order based on your specifications. Production time is typically 2-3 weeks from order confirmation. Custom orders are final sale and cannot be returned unless defective.

SECTION 4 - Pricing, Billing, and PayJustNow

  • Currency & VAT: All prices are in ZAR. VAT is included (VAT No: 4640307593).

  • Customization: Personalization adds R250 to the order total.

  • Payment: We accept Visa, Mastercard, EFT, PayFast, and PayJustNow.

  • BNPL Services: If you choose PayJustNow, you enter into a separate agreement with a third-party provider. We are not responsible for the terms of that third-party agreement.

SECTION 5 - Shipping and Delivery

  • Providers: We partner with The Courier Guy (Door-to-Door) and PEP/Paxi (Point-to-Point).

  • Risk: Once we transfer products to the carrier, title and risk of loss pass to you.

  • Collection: You are responsible for collecting Paxi parcels from your designated PEP store within the carrier's timeframe.

  • Delays: Delivery times are estimates, not guarantees.

SECTION 6 - Optional Tool and Third-Party Links

We may provide you with access to third-party tools (like payment widgets), which we neither monitor nor have control over. Any use of optional tools or third-party links is entirely at your own risk. We are not liable for any harm or damages related to the purchase or use of goods or services from third-party websites.

SECTION 7 - User Feedback and Submissions

If you send us creative ideas, suggestions, or reviews (collectively, 'feedback'), you grant us a perpetual, worldwide, royalty-free license to use, edit, and distribute that feedback. We are under no obligation to maintain feedback in confidence or pay compensation for it.

SECTION 8 - Relationship with Shopify

SULM8 is powered by Shopify. You acknowledge that Shopify is not responsible for any aspect of the sales between you and SULM8. You hereby expressly release Shopify and its affiliates from all claims and liabilities arising from your transactions with us.

SECTION 9 - Warranties; Limitation of Liability

  • Product Warranty: We warrant products against material defects in workmanship for 90 days from delivery.

  • General Disclaimer: The service and products are provided 'as is' and 'as available' for your use, without any representation or warranties of any kind.

  • Limitation: In no case shall SULM8, our directors, or employees be liable for any injury, loss, or consequential damages. Our total liability shall not exceed the amount paid for the product.

SECTION 10 - Indemnification

You agree to indemnify, defend, and hold harmless SULM8 and Shopify from any claims or losses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your violation of any law.

SECTION 11 - Severability and Termination

  • Termination: We may terminate this agreement at our sole discretion at any time without notice. You remain liable for all amounts due up to the date of termination.

  • Severability: If any provision of these Terms is determined to be unenforceable, such provision shall be severed, but the remaining provisions will remain in full force and effect.

SECTION 12 - Governing Law

These Terms of Service are governed by the laws of South Africa. You and SULM8 consent to the jurisdiction of the South African courts.
